Terms and Conditions

 ******In order to secure your date and event, Memorable Events requires a security deposit be provided at the signing of contract. 

**Deposit is Non Refundable**

This deposit will be deducted out of the total amount due. 

Remainder amount needs to be paid 2 weeks prior to the event date. 

***SHOULD YOUR EVENT BE CANCELLED THE DEPOSIT OR PAYMENTS MADE ARE NON REFUNDABLE! ****

A retainer fee listed on contract is required to hold that time and date secure for your wedding/event. If customer postpones or changes any event set forth above, and Memorable Events LLC is unable to complete services for your wedding/event due to customer changes, or if the customer cancels this contract under any conditions, the retainer and payments made are not refundable. 

If there are any changes to the schedule, please notify Memorable Events LLC immediately in writing. The contract must be amended to confirm any such changes & approved by Memorable Events LLC. It is the customer’s responsibility to call two weeks prior to wedding/event to confirm all arrangements. 

The remaining balance listed on contract is to be paid 2 weeks prior to the date of your wedding/event. If the balance is not paid on the event date, then Memorable Events LLC services will not be provided. Each customer signing this contract shall be fully liable for all obligations of customer hereunder, and such liability shall be joint and severed. 

Memorable Events LLC may cancel this contract at anytime and reserves the right to refuse service. 

Memorable Events LLC takes the utmost care with respects to the developments and delivery of your event needs.

Liability Waiver 

“The undersigned hereby assumes all risk of injury or harm as a result of the activities specified above and agrees to release, indemnify, defend, and forever discharge the release (Memorable Events LLC)  from all liability, claims, demands, damages, costs, expenses, and causes of action due to death, injury, loss, or damage to the event company Memorable Events LLC. 

MEDIA CONSENT, RELEASE, AND WAIVER 

SOCIAL MEDIA, PHOTO, VIDEO Press Release

   I hereby give consent to ______________________________________ (the “Memorable Events LLC”) to photograph, videotape, or otherwise digitally record and use images and/or sound recordings of myself or my child or children (if applicable) to use in any public media, including radio, television, internet, social media, print etc.    

INCLEMENT WEATHER POLICY

The following guidelines are recommended for Outdoor Events and special events in the event of inclement weather. Memorable Events LLC has the right to cancel/postpone or relocate décor/rentals for safety in the event of any storm warnings issued by the National Weather Service, Public Safety, or Recreation Department for any tornadoes, hurricanes or other severe storms. Cancellations, postponements and relocation of activities will be done in a timely manner. Events will be canceled/postponed a minimum of thirty minutes to one hour prior to the scheduled start time depending on the type of activity. Emergency alert warnings may require prompt cancellations. 

NOTIFICATION PROCESS Depending on the type of weather event and impact, staff will communicate via email, word of mouth, posting on the website, or other media sources regarding any cancellation/postponing information. Weather conditions and the type of facility may vary from center to center in The Villages community. 

INCLEMENT WEATHER Inclement weather is defined as rain, wind, lightning and/or severe conditions (tornado, hurricane, thunderstorm watch/warnings) that compromise the safety of the participants, staff, volunteers and/or the condition of the rentals or decor.

WEATHER TEMPERATURE Cancellations/postponements related to Temperature. 

TEMPERATURE GUIDELINES.  Outside temperature of 35 degrees or lower. • Outside temperature with a heat index of 104 degrees or higher.

• In the event of Inclement weather, Memorable Events LLC recommends patrons at outdoor areas find shelter and wait at least 30 minutes or longer prior to resuming safe normal activities as deemed advisable by a Public Safety or National Weather Service Advisory.  

Rental Policy

Lessee will be responsible for ALL merchandise until items are returned back to Memorable Events LLC. Please make sure that all items are secured when not in use and protected from wind/water damage. This includes inclement weather, outdoor sprinklers, pools, pets and wet/damp surfaces. __________Initials

Lessor (Memorable Events LLC) shall not be liable to Lessee for any loss, delay or damage of any kind resulting from defects or inefficiency of the rented property or accidental breakage. Lessee agrees to indemnify and holds harmless the Lessor (Memorable Events LLC) against all loss, damage, expense, and penalty arising from any action on account of any injury to person or property occasioned by the use for the time merchandise is not in our rent-able possession. __________Initials 

Any items returned damaged will be assessed the cost of repairs at the Lessee’s expense. If the items are broken or damaged beyond use Lessee will be responsible for the replacement cost of said items. Lessee is responsible to return items clean and in the same manner that they were delivered/picked up. _______Initials 

If we are forced to take legal action to recover our merchandise or repair/damage fees Lessee will be responsible for any and all legal fees. Additionally we retain the right to charge for the loss of use for the time merchandise is not in our rental possession. _______Initials 

*****Charges for delivery are based on delivery zip code. The delivery is to the site and pick up from the same location. Delivery may be higher for some locations. Delivery is made to ground level only, therefore, please make delivery arrangements explicit. Extra charges will be assessed for stairs and/or when long distance carrying is involved. *****
